Terms of Service

Welcome to Beijing Tongming Technology And Trade Co., Ltd. (hereinafter referred to as "the Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our mobile applications, games, websites, and professional services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use our Service.

1. Business Cooperation and Service Delivery Models

The Company operates through three primary professional frameworks, providing specialized services to global clients and users:

1.1 Project Proxy Operation (Co-Operation)

We provide comprehensive operational services for third-party mobile projects. This includes global user acquisition, community management, data-driven optimization, and localized marketing. Partners engaging in proxy operations are subject to specific Service Level Agreements (SLAs) regarding performance metrics and revenue sharing models.

1.2 Project Outsourcing R&D (Custom Development)

The Company undertakes high-performance mobile application and game development projects for global clients. All R&D projects are executed under strictly defined technical specifications, milestone deliveries, and intellectual property transfer protocols as agreed upon in individual project contracts.

1.3 Self-Developed Operations

We develop and operate a proprietary portfolio of digital products. These products utilize advanced monetization strategies including in-app subscriptions, virtual currency systems, premium feature access, and integrated advertising (Ad-tech). Users of self-developed projects are granted a limited, non-transferable license for personal, non-commercial use.

2. User Obligations and Intellectual Property

Users must comply with all applicable laws and regulations. All content, including but not limited to source code, graphics, UI design, trademarks, and logos, is the exclusive intellectual property of Beijing Tongming Technology And Trade Co., Ltd. Unauthorized reproduction, modification, or distribution of these materials is strictly prohibited.

3. Monetization and Virtual Assets

Any virtual items, currencies, or subscriptions purchased within our Service are licensed to the user for in-app use only. These assets have no real-world monetary value and are non-refundable, except where required by the refund policies of the respective distribution platforms (e.g., Google Play Store, Apple App Store) or local mandatory consumer protection laws.

4. Governing Law and Dispute Resolution

The Company is committed to resolving any disagreements through professional communication and mutual cooperation. In the event that a formal dispute arises:

• Governing Law: These Terms and any related actions shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions.
• Amicable Resolution: Before initiating any formal legal proceedings, the parties agree to attempt to resolve the dispute through friendly negotiations for a period of at least thirty (30) days.
• Jurisdiction: Any dispute that cannot be resolved through negotiation shall be submitted to the exclusive jurisdiction of the people's courts in Shunyi District, Beijing, China, for litigation.
• Arbitration Option: By mutual written agreement, parties may alternatively elect to resolve disputes through binding arbitration under the rules of the China International Economic and Trade Arbitration Commission (CIETAC).

5. Platform Policy Adherence

Users and business partners acknowledge that our Service is distributed through third-party platforms. In addition to these Terms, users must comply with the Developer Distribution Agreements and Terms of Service provided by Google LLC and Apple Inc. Any violation of platform policies may result in immediate suspension of the user's access to the Company's Services.

6. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use the Service. We do not warrant that the Service will be uninterrupted or error-free.

7. Amendments to Terms

The Company reserves the right to modify these Terms at its sole discretion. Continued use of the Service following any updates constitutes acceptance of the revised Terms. We recommend reviewing this page periodically for any changes.
